New York Disability Benefits Law

In 1949 the Workers’ Compensation Law was amended to include Article IX. This Article IX of the Workers’ Compensation Law became known as the Disability Benefits LAW (DBL) and provides benefits for elegible employees who are incapacitated by illness or disability by a non occupational injury.

Workers’ Compensation mandates benefits for on the job injury and work related illness.

Benefits

  • 50 percent of employee’s average weekly wage (based on eight weeks of employment prior to disability) to a maximum weekly benefit of $170 a week
  • Benefits are payable for a maximum of 26 weeks during any consecutive 52 week period
  • Benefits are payable after a seven day waiting period for both accident and sickness

Employers situated in zip code range 10000<11999 with no other Guardian group coverage can take advantage of the following stand alone rates:

Small groups with 1 to 49 employees sitused in zip code range 10000<11999 insured under any Guardian non-medical coverage group policy (cross sold) will be reduced to the following rates:

Males $ 20.16
Females $ 47.04
Monthly Rate (payable quarterly)
Males $ 2.30
Females $ 5.00

All other groups located in zip codes OTHER then 10000<11999 can take advantage of the following rates.
Stand Alone- no other Guardian coverage in force.

Minimum quarterly premium of $ 15 and annual premium of $ 60 are applicable to all small groups.Monthly and annual rates for a sole proprietor or partners are $ 6.85 and $68.86 respectively (must have at least one employee).
